Article 1 to implement the State Council's opinions on strengthening the implementation of innovation driven development strategy and further promoting the in-depth development of mass entrepreneurship and innovation among all people (GF [2017] No. 37) and the notice of the State Council on measures to optimize scientific research management and improve scientific research performance (GF [2018] No. 25), and to implement innovation and entrepreneurship sharing actions, The implementation rules are formulated in accordance with the spirit of the national science and technology plan and the regulations on the management of special fund post subsidy (CAI Jiao [2013] No. 433) and relevant provisions on the project and fund management of the Municipal Science and technology plan.

Article 2 the Municipal Bureau of science and Technology (hereinafter referred to as "Municipal Bureau of science and technology") uses the financial and technological development funds to establish the special fund for technical innovation and achievement transformation of scientific research institutions in Chongqing (hereinafter referred to as "guiding special fund"), which shall guide and support scientific research institutions to use scientific and technological talents, scientific research instruments and equipment, scientific data through the way of allocating funds after the completion of the acceptance In cooperation with industry enterprises, scientific and technological achievements and other resources should be invested in the implementation of projects, and the transformation of industrial technological innovation and scientific and technological achievements should be promoted in a targeted way, and the backbone and leading role of scientific research institutions in regional innovation system should be enhanced.

Article 3 the guiding special project shall adhere to the principle of "goal orientation, production research cooperation, competition and selection of excellent, prior project approval and post subsidy", and support scientific research institutions to organize and implement technology and product development projects and achievement application demonstration projects.

Technology and product development project is guided by market demand and enterprise investment, and focuses on supporting scientific research institutes to focus on enterprise demand. Research and development of new technologies, new methods, new products and key components with innovation, maturity, stability and reliability, and enhance scientific and technological innovation ability and market competitiveness of scientific research institutions.

The demonstration projects of application achievements should be guided by large-scale application and intra industry promotion. The research institutes should support scientific research institutions to promote scientific and technological achievements with integration, advanced nature, economic applicability and radiation leading role, and enhance the profits of scientific research institutions and the economic benefits of enterprises.

Article 4 the reporting body of the special project shall be Chongqing scientific research institution. It includes municipal scientific research institutes, district and county scientific research institutions and municipal non enterprise units of science and technology.

Article 5. Guide special projects to implement different implementation cycles, funding, generation methods and project approval requirements according to different types.

The implementation cycle of technology and product development project shall not exceed 3 years. When applying for the project, the scientific research institution shall reach a research and development and experimental development cooperation agreement with the enterprise in advance, and stipulate the main items such as the project R & D content, research and development investment mode and quota. The subsidy amount after the project is 500000 yuan or 1 million yuan per item. The subsidy funds for the project after the application of scientific research institutions shall not exceed 50% of the total amount of the horizontal funds agreed upon in the implementation of the project.

The implementation cycle of the demonstration project of achievement application shall not exceed 2 years. When applying for projects, scientific research institutions shall reach an agreement with enterprises in advance on transfer and transformation of scientific and technological achievements or industrialization, and agree on the way of income distribution. The subsidy after the project is RMB 1 million per item. The scientific research institutions applying for the project agree that the total income from the transformation of scientific and technological achievements shall be more than 2 million yuan.

The total amount of horizontal funds referred to in paragraph 2 of this article refers to the sum of research and development and experimental development expenses paid by enterprises to scientific research institutions; The total amount of income from the transformation of scientific and technological achievements referred to in paragraph 3 refers to the sum of funds such as transfer fees, licensing fees or dividends paid by enterprises to scientific research institutions, excluding sales income of products.

Article 6 the scientific research institutions shall declare and implement the special projects for guidance, and the enterprises shall be the project cooperation units.

The project cooperation unit does not include the enterprises with equity relationship and subordinate relationship with scientific research institutions.

Article 7 the Municipal Bureau of science and technology does not issue guidance for special projects. Scientific research institutions shall focus on the problems of industrial research or industrial development according to the needs of the city's economic and social development, independently decide the project name and research direction, independently select the contents of cooperative enterprises and projects, and independently determine the objectives and tasks and technical routes.

If a scientific research institution has obtained the support of Municipal Science and technology plan or financial special fund, it cannot declare and guide the special project.

Article 8 guide special projects to implement the management of limited items.

Within the same year, the number of scientific research institutions applying for technology and product development projects has been included in the national R & D funds statistical survey shall not exceed 3, and other scientific research institutions shall not exceed 1; For the application demonstration projects of application of application results, no more than 2 scientific research institutions shall be provided.

If the same category of projects has not been completed or terminated, each scientific research institution shall reduce the number of applications for the same category of projects accordingly.

Article 9 the guiding special projects shall be mainly under the independent management of scientific research institutions. The Municipal Bureau of science and technology does not carry out process inspection, but only organizes project acceptance.

Article 10 scientific research institutions shall establish separate accounts for the projects one by one to record the income and expenditure of the funds involved in the project in detail.

Article 11 after the signing and entry into force of the task statement of the guiding special project, the contents cannot be adjusted or changed. Except for the reasons of force majeure, the project acceptance shall not be postponed.

If the scientific research institutions cannot complete the task of guiding special projects on time, they shall apply to the Municipal Bureau of science and technology for termination of the project. If the project is not applied for acceptance at the expiration of the term, the Municipal Bureau of science and technology shall force the termination of the project.

Article 12 guide special projects to be implemented in accordance with the following procedures:

（1） Notice. The Municipal Science and Technology Bureau issued the notice of guiding special project application, and clarified the time limit and requirements of the application.

（2） Declaration. Scientific research institutions voluntarily fill in the application form for guiding special projects, and provide legal agreements with the cooperative enterprises on the items such as project content, capital investment or income distribution, and submit them to the Municipal Science and Technology Bureau.

（3） Review. The Municipal Science and technology bureau organizes expert group to review the application materials of the guiding special projects to form the evaluation opinions.

（4） Project approval. According to the evaluation results, the Municipal Science and Technology Bureau shall select the best to determine the project to be set up, and publicize the project name, project undertaking unit (including project cooperation unit), and the amount of post subsidy funds applied for by the society. If there is no objection after publicity, the Municipal Science and Technology Bureau and scientific research institutions shall sign a project assignment with detailed description of the assessment index and acceptance method.

（5） Acceptance. Before the project implementation period expires, the scientific research institutions can apply for project acceptance after they complete the project tasks and the total amount of agreed lateral funds or the total income from scientific and technological achievements transformation is fully in place.

The Municipal Bureau of science and technology, according to the application of scientific research institutions and the acceptance data submitted, organizes the expert group to carry out the acceptance according to the project assignment, and forms the acceptance opinions.

（6） Appropriation. The Municipal Science and Technology Bureau shall determine the projects to be given post subsidy according to the acceptance opinions and publicize them to the society. If there is no objection after public announcement, the subsidy fund shall be allocated once.

Article 13 guide the special implementation of the scientific research management mechanism based on trust. Scientific research institutions declare and implement the guiding special projects to adhere to honesty and trustworthiness. If there are behaviors such as fraud, falsification of results, repeated application for project approval, and provision of false proof materials, such acts shall be included in the management of scientific research dishonesty, shared with credit information in other social fields and joint punishment shall be implemented.

The scientific research institutions actively apply to the Municipal Bureau of science and technology to terminate the implementation of the special guiding project, and do not carry out the scientific research credit record. If the Municipal Science and Technology Bureau forcibly terminates the implementation of the guiding special project, it shall record the scientific research credit of the scientific research institutions and the project leaders.

Article 14 the subsidy funds after guiding special projects shall be managed as research and development and experimental development funds by scientific research institutions, and used for organizing and implementing scientific research projects to improve the basic research level and technological innovation ability of their own units. The project shall meet the category and requirements of the Municipal Science and technology plan project. Project management adheres to the principle of independent selection, independent project approval and independent completion of the project, which is determined by scientific research institutions.

Scientific research institutions may recommend to the Municipal Bureau of science and technology the project management system of Chongqing Science and technology plan to be put into storage in written form for scientific research projects organized and implemented by the subsidy funds after guiding special projects. After the comprehensive evaluation of experts organized by the Municipal Bureau of science and technology, the Municipal Science and technology plan of the corresponding category shall be issued for the projects meeting the requirements.

Article 15 scientific research institutions shall accept the inspection and supervision of the departments of science and technology, finance and auditing over the use and management of subsidy funds after guiding special projects.

The illegal acts found in the inspection shall be dealt with in accordance with the regulations on punishment and punishment of financial illegal acts and other relevant provisions.

Article 16 the implementation rules shall be implemented as of January 1st, 2019.
